DFW Home Experts ISAOA's Service Agreement (aka: Terms and Conditions) is designed to help our clients understand the service they are purchasing. These terms clarify and describe our guarantee, exclusions, cancellations and potential problems we strive to avoid if at all possible.
With your help, these issues can be avoided to ensure a successful service to you in your home. These Terms of Service define the responsibilities and liabilities of DFW Home Experts ISAOA, and our customers.
We work to earn your continuing business with each and every service.
PLEASE BE AWARE THAT BY SCHEDULING SERVICE(S) THROUGH DFW HOME EXPERTS ISAOA, YOU AGREE TO OUR TERMS OF SERVICE AS STATED BELOW.
THIS DOCUMENT SERVES AS A BINDING AGREEMENT BETWEEN THE PROPERTY OWNER, AND DFW HOME EXPERTS ISAOA, ISAOA AND ITS AGENTS, OWNERS, EMPLOYEES AND SUBCONTRACTORS, HEREBY IDENTIFIED AS FOR THE EXECUTION OF SERVICES IN EXCHANGE FOR PAYMENT FOR ALL OF OUR SERVICES.
PERMISSIONS
Client or his/her agent agrees to allow DFW Home Experts ISAOA, on the property for the purposes of scheduled services. Client understands that there is no set time frame for the completion of services and several visits to the property may be required. DFW Home Experts ISAOA, ISAOA/ISAOA also has the permission to visit the property with little or no notice to assess service needs prior to the date of service, as well as to check completion after services have been rendered.
SATISFACTION GUARANTEE
Your satisfaction is guaranteed. Because a great many of our services are a subjective service, DFW Home Experts ISAOA, can’t offer refunds once work has started. However, we do offer a 100% satisfaction guarantee (the “Satisfaction Guarantee”). This means we will continue to work to accommodate you, including arranging for additional Services to correct defective or deficient work, until you are 100% satisfied with the outcome. If you are not completely satisfied with any part of your service we will return to your home within 14 business days or we'll apply a credit into your account towards our next visit.
If you are home and notice that the technician overlook something please don't keep it to yourself, tell the technician to or call our office before the technician leaves your home. Please contact the office as soon as possible during our normal business hours.
PAYMENT TERMS
For your convenience, we gladly accept the following forms of payment: MasterCard/Visa, AMEX, cash or check. We require payment for all services upon completion of service(s) unless other arrangements have been agreed to by both parties.If no payment has been made by the at service (s) completion , DFW Home Experts ISAOA, ISAOA will use reasonable endeavors to contact the Customer for payment. In the event that DFW Home Experts ISAOA, ISAOA cannot contact the Customer or payment is not made within 48 hours, the Customer will be subject to late fee for Service, and the Customer must pay any fees.
Please understand that when you provide payment in full to DFW Home Experts ISAOA and our technicians leave your home UNLESS otherwise agreed in writing by both parties, we will have fully satisfied our contractual obligation to you and payment is due in full. You understand and agree that all sales are final and there are no refunds.
If you are not completely satisfied with any part of your service we will return to your home to re-clean the area/task within 7 business days or we'll apply a credit into your account towards our next visit.
You further agree that there are no circumstances under which you will be entitled to a refund or the right to dispute the charge with your bank or credit or debit card DFW Home Experts ISAOA, for any reason no matter what your claim.
The Customer agrees to pay the price quoted by DFW Home Experts ISAOA, in full upon conclusion of the Service, unless otherwise agreed in writing in advance with DFW Home Experts ISAOA . If no payment has been made by completion of scheduled service(s), DFW Home Experts ISAOA, will use reasonable endeavors to contact the Customer for payment. In the event that DFW Home Experts, cannot contact the Customer or payment is not made within 48 hours, the Customer will be deemed to be late, and the Customer must pay any late and/or collections fees as described herein. Payments may via credit card may be made on the company website.
CASH PAYMENTS TERMS
To pay cash, please contact the office. Cash payments NOT approved by in-office personnel and remitted to technicians will be considered a tip and total invoiced payment will be due in full immediately.
PERSONAL CHECK PAYMENTS TERMS
We are happy to accept your personal check as a form of payment. Checks are required to be made payable to name reflected on invoice. Any checks with “Pay to the Order of” left blank or made to the order of anyone or anything else not reflected on invoice will be considered a tip and total invoiced payment will be due in full immediately. Returned checks will be subject to a $75 dollar fee and payment of check amount plus fee will be due and payable immediately and accepted only in cash. .You understand and agree that all sales are final and there are no refunds. You further agree that there are no circumstances under which you will be entitled to a refund or the right to dispute the charge with your bank or stop payment on the check for any reason no matter what your claim. You agree that your bank may use this disclaimer to refute any dispute that you may initiate for whatever reason. If you fail to make payment in FULL (including $75 fee)-your check will be referred to the Criminal District Attorney's Office in the County for Theft Of Services Criminal Prosecution. DFW Home Experts ISAOA will also proceed to file Mechanic's Lien on the address service was provided to and/or the person(s) service was provided for.
CREDIT CARD PAYMENT TERMS
We are happy to accept payment via MasterCard, VISA, Discover or American Express (AMEX). All credit card payments shall be subject to the terms of this agreement. Payments made via MasterCard, VISA, Discover or other accepted cards EXCEPT AMEX will incur a convenience fee of 2.9% of the total invoiced amount added and .45 cents. Payments made via AMEX will incur a convenience fee of 3.9% of the total invoiced amount added and .75 cents.
You understand and agree that all sales are final and there are no refunds. You further agree that there are no circumstances under which you will be entitled to a refund or the right to dispute the charge with your bank or credit or debit card DFW Home Experts ISAOA, ISAOA/ISAOA for any reason no matter what your claim. You agree that your bank or credit card or debit card DFW Home Experts ISAOA, ISAOA/ISAOA may use this disclaimer to refute any dispute that you may initiate for whatever reason.
COLLECTION FEES
A $95 fee will be assessed for all monies owed that must go to our collections office.
TIPPING
Although it's not necessary to tip our employees it is encouraged, and of course the best way to say job well done! You may include your tips with your payment and we will pass them along to our technicians or give it to them directly.
LOCK OUTS
A $65 fee will be assessed in the event that our cleaning associates arrive and are unable to access the premises. This fee is in place to cover expenses we incur for lost travel time and fuel.
CANCELLATIONS
Any appointment cancelled less than 24 hours prior to the scheduled appointment time will be subject to a $65 cancellation fee. Same day cancellation is $80.
ADDITIONAL SERVICES
Any changes to the Service to be provided must be agreed by DFW Home Experts ISAOA office staff prior to the Service Time. If the Customer requires any additional services or variations at the time the Service is being performed, the Customer must first contact by telephone, who may agree to provide the additional services in its absolute discretion. The Technician is not authorized to agree to any changes to the Service being provided. The Customer must not request such changes directly from the Technician. All communication has to go through our office.
NO ENGAGEMENT OF TECHNICIANS OR SERVICE PROVIDERS
The Customer acknowledges DFW Home Experts ISAOA, invests significant resources in recruiting, selecting and training its Technicians. Unless DFW Home Experts ISAOA, gives prior written permission, the Customer must not, directly or indirectly, engage, employ or contract with any Technician to provide domestic services to the Customer or any associate of the customer for any period during which services are provided by DFW Home Experts ISAOA, for a period within 36 months after the conclusion of any Service. The Customer acknowledges that DFW Home Experts ISAOA, may suffer loss and damage, including, without limitation consequential loss, as a result of a breach of this clause by the Customer and that DFW Home Experts ISAOA will pursue all remedies as available by law.
BOOKINGS
The Customer may make a booking personally over the telephone or via our website. We do not accept third party booking unless he or she will be paying for the service. At the time of booking the Customer must provide details of any hazards, slippery surfaces, risks or dangers, ingrained dirt, grease or grime located at the Premises; DFW Home Experts ISAOA, provides all quotations at the time of booking. The Customer agrees to provide DFW Home Experts ISAOA, with their valid credit card details at the time of booking, and authorizes DFW Home Experts ISAOA, to debit any card with an amount equal to any service and/or cancellation fees that may apply under this Agreement and is subject to all Credit Card terms in TOS. DFW Home Experts ISAOA, reserves the right not to accept a booking for any reason.
MEDIA RELEASE
Client agrees to allow DFW Home Experts ISAOA, to utilize any photos, descriptions, reviews, quotes, or videos of the property and/or the client in the context of marketing or advertising for the DFW Home Experts ISAOA,. The DFW Home Experts ISAOA, will use these items described in this section without any compensation to the Client. Client agrees not to seek punitive action in a civil court of law regarding the development, display, reproduction, or printing of the above examples of media. This does include the use of photos,addresses, testimonials and videos posted or displayed on online venues such as social media and or the DFW Home Experts ISAOA’s website. The Client also agrees to allow the DFW Home Experts ISAOA, to display a marketing sign on their property for no more than one week (seven calendar days). Any damage to this sign will be charged to the client at full retail cost.
WARRANTY PERIORD
DFW Home Experts ISAOA, ISAOA has a 48 HOUR WARRANTY PERIOD from the day of completion of the cleaning. If we have missed an area, damaged or broken an item, please call within that time frame and we will come out and re-clean the area in question per our Terms & Services. We work very hard to avoid these issues by training our staff to be careful and detail oriented, and by inspecting our work. Complaints filed more than 48 hours after the completion of cleaning fall outside the warranty period, and unfortunately may not be covered. DFW Home Experts ISAOA, will not be held responsible for repair or replacement of items broken or damaged due to pre-existing wear and tear, incorrect installation, assembly or usage.
DFW Home Experts ISAOA, is not responsible for not completing or providing the Service as a result of a breach of a warranty by the Customer (including a failure by the Customer to provide proper materials, cleaning equipment, utility services, a safe working environment or unencumbered access to the Premises); or any damages caused by defective cleaning materials or cleaning equipment provided by the Customer; not completing or providing the Service as a result of the Technician not proceeding for health and safety reasons; any loss or damage incurred by the Customer or any third party as a result of the effects of a force majeure, being any event beyond the reasonable control of DFW Home Experts, ISAOA; not completing or providing the Service due to an act or omission of the Customer or any other person at the Premises during provision of the Service; existing dirt, wear, damage or stains that cannot be completely cleaned or removed; any wear or discoloring of fabric or surfaces becoming more visible once dirt has been removed; any loss incurred as a result of any breakage or damage to goods, items of value (including antiques, items of sentimental value) or the Premises.
REPRESENTATION S & WARRANTIES
DFW Home Experts ISAOA’s technicians are well trained in utilizing their equipment and take the upmost precautions in making sure the DFW Home Experts ISAOA, does not cause harm to your investment. Damage can still occur due to poor maintenance, neglect to the property, and/or low grade building materials. Homeowners should consult with their homebuilder to insure that their home’s materials are able to be pressure washed. It is the responsibility of the homeowner to insure that their property has been maintained in accordance with its manufacture’s recommendations and any defects or areas of concern are repaired prior to requested service(s). The Homeowner assumes all of these risks and takes responsibility for any damage that occurs due to the above explanations. When any damage is found, the DFW Home Experts ISAOA, will cease all cleaning efforts until the client can see the damage and acknowledge its existence. The Client also agrees to release the DFW Home Experts ISAOA, of any or all liability for injuries sustained due to equipment placement to include injuries from tripping/falling, striking equipment, falling debris or equipment. DFW Home Experts ISAOA, shall only be obligated under this Contract for structural damages which are a direct result of operator error, gross negligence, or willful misconduct. Damages must be discovered and reported within 3 calendar days of said completion. Upon receipt of written notice The DFW Home Experts ISAOA, shall be allowed 30 calendar days from date of receipt for the purpose of inspecting the premises. DFW Home Experts ISAOA shall have sole option of repairing or contracting repair work to correcting any structural damages that are a direct result of the DFW Home Experts ISAOA,.
The Customer represents and warrants that: it will provide a safe working environment at the Premises for the Technician to perform the Service; the Technician will have unencumbered and unobstructed access to those areas of the Premises requiring the Service; it will provide the Technician with access to all services and utilities (including hot and cold water, electricity, and rubbish bins) as required by the Technician to provide the Service; it will provide all usual and necessary cleaning equipment and materials required by the Technician to provide the Service, unless other arrangements have been made with DFW Home Experts ISAOA, ISAOA all cleaning equipment and materials provided by the Customer are safe, have not been tampered with and are in full working order; it will advise DFW Home Experts ISAOA, prior to the commencement of the Service of any hazards, slippery surfaces, risks or dangers, ingrained dirt, grease or grime at the Premises; it is authorized to use the Premises and obtain the provision of Service; if the Customer requires the Technician to clean behind or under any heavy items (e.g. a fridge, bookshelf, or other furniture), it will move those items prior to the commencement of the Service; and it will secure or remove any fragile, delicate, breakable or valuable items, including cash, jewels, works of art, antiques, or items of sentimental value prior to the commencement of the Service.
HEALTH & SAFETY RISKS
In addition to the obligations and warranties set out in clause 3 above, the Customer acknowledges and agrees that: the Technician is entitled to undertake a job safety analysis before the commencement of any work to assess the health and safety risk at the Premises; the Technician may, either before or during the provision of the Service not use or cease using any materials or cleaning equipment provided by the Customer if the Technician thinks, in his/her absolute discretion, that the use of such materials or cleaning equipment poses a risk to health and safety. the Technician may, either before or during the provision of the Service not provide or cease the provision of the Service where carrying out theService presents, in the absolute discretion of the Technician, a risk to health and safety.
PRIVACY POLICY
The Customer acknowledges that any information provided by the Customer may be used by DFW Home Experts ISAOA, for the purpose of providing the Service. DFW Home Experts ISAOA agrees not to share any information provided by the Customer with any third party not directly involved in the provision of the Service (unless required to do so by law). The Customer agrees to DFW Home Experts ISAOA, communicating with them electronically and/or via other means in order to provide the Service or for reasons related to the provision of the Service. DFW Home Experts ISAOA, will take all reasonable precautions to protect personal information provided by the Customer from loss, misuse, unauthorized access or disclosure, alteration or destruction.
ADDITIONAL TERMS OF SERVICE FOR WINDOW & GUTTER CLEANING SERVICES
WINDOW CLEANING is performed by trained technicians with professional tools and conventional methods. Window cleaning is generally defined as wetting the surface of the glass, scrubbing it with a mop and cleaning solution, and then using a squeegee on the surface. Pollution, hard water stains, building run-off and corrosion can reduce the clarity of glass, and this clarity cannot be restored by these conventional cleaning methods. The LOW estimate is based on normal full operation of all windows being present. The LOW estimate is for a maintenance cleaning and does not take into consideration any additional difficulty in removing, cleaning and re-installing the storms due to unforeseeable issues. Any and all issues regarding the job and or price can be brought to the client’s attention as it occurs upon request at scheduling.
RAIN GUARANTEE
Rain water won’t make clean windows dirty, so we offer a Rain Guarantee the length of which is included in your confirmation. Our EXCLUSIVE bio-friendly solution bonds with the glass and REPELS dirt, dust, pollen, and rain, keeping your windows sparkling for 4-6 months!!
CONSTRUCTION, REMODELING, PAINTING, AND OTHER DEBRIS and/or abrasive materials on the customer's property will often leave windows with significant debris upon the glass that requires the use of a mop, squeegee, and razor blades to clear. DFW Home Experts ISAOA, LLC , uses industry standard tools manufactured specifically for professional window cleaners and uses those tools in a professional manner. Most customers are elated with their clean windows, but occasionally some scratches are discovered after the windows are clean and able to be seen through clearly. The expense of repairing or replacing these windows presents such a liability that DFW Home Experts ISAOA, LLC chooses not to work for Customers who will not indemnify and hold harmless DFW Home Experts ISAOA, LLC. DFW Home Experts ISAOA, LLC provides standard cleaning and pricing does not take into account (unless otherwise noted)for any paint scraping, stain or oxidation removal or any other issue that would not be covered with a mild soap solution, light scrub and/or general scrape, and squeegee. All of these can be discussed but would be subject to our rate per man hour calculation.
STORM WINDOWS - are removable panels of glass installed over the original windows for added insulation purposes. In order to clean these windows, it is necessary to remove, clean and put back the storm panel. There is a risk of the glass cracking in the process of lifting, prying and pulling in order to loose the window from the frame.DFW Home Experts ISAOA, LLC staff has been cleaning these storm windows for many years with relatively few incidents of breakage and most often there is a favorable outcome. Occasionally there is a window that does crack during the removal process or reinstallation. The expense of repairing or replacing these windows presents such a liability that DFW Home Experts ISAOA, LLC chooses not to work for Customers who will not indemnify and hold harmless DFW Home Experts ISAOA, LLC. There will be an additional charge for each storm window.
SCREEN CLEANING- The screen cleaning method is one of the reliable window cleaning methods used by our team of experts. If you have screens installed in your home, our team will remove them gently before commencing the cleaning of your windows. By applying mild force, we will clean both sides of the screen and dry them before we start cleaning any of your windows. Occasionally there is a screen that does bend or tear during the removal process or reinstallation. The expense of repairing or replacing these screens presents such a liability that DFW Home Experts ISAOA, LLC chooses not to work for Customers who will not indemnify and hold harmless DFW Home Experts ISAOA, LLC .There will be an additional charge for solar screens.
PRE-EXISTING CONDITIONS- If requested, we will notify you of pre-existing damage or the general condition of your windows. We are not responsible for pre-existing damage or damage waiting to happen, i.e. poorly or unattached blinds that fall down. We have yet to clean a house without one or more windows that have broken seals, low-e failure, scratches, broken blinds, bent screens, or other damage. Broken windows will not be cleaned. We will do our best to notify you of these conditions but since they are common and occur in every house, please understand we may not be able to notify you of each and every instance.
SPECIAL ORDER / AFTER-MARKET PRODUCTS- DFW Home Experts ISAOA, LLC will not be liable for scratches, blemishes, or damage resulting from the cleaning of glass, frames, or related products with window films, applied finishes, laminations of any kind, or special order custom products that require special treatment. If products will not tolerate conventional cleaning methods (such as detergents, razors or steel wool) the customer is responsible for notifying DFW Home Experts ISAOA, LLC in writing prior to scheduling
GUTTER CLEANING - is performed with the intent to satisfy the industry standard of clearing debris from gutters and downspouts to facilitate the evacuation of rainwater from roof areas. In addition to safety gear, we often use hand tools, blowers, and/or a water hose to effectively remove debris that is blocking the gutter. In areas that are directly in the view of the homeowner (i.e., gutters below an upstairs window or a low gutter along a sidewalk) we will endeavor to raise the standard to improve the homeowner's view of the interior of the gutter. Trying to accommodate this "aesthetic view" standard in all gutters is counterproductive to homeowner's interests in the areas of economic cost and water conservation. In addition to these areas, if we wash the inside of the gutters, it is possible to wash grit and fine debris down the drains that would not otherwise end up in the underground drain system.
DFW Home Experts ISAOA, LLC CAN ONLY GUARANTEE that your gutters will be reasonable clear on the day that we clean them. Gutter cleaning is a task that needs to be done periodically to prevent water from overflowing the gutters in ways other than the natural design of the gutters. How often this gutter cleaning should occur is a function of how many trees are around your home and your budget. Due to the constant changes in weather and large amounts of organic debris that are in our environment, debris can enter a gutter and clog downspouts on any given day.
EXTERIOR HOUSE WASHING-Includes cleaning of the outer *gutter surfaces using specialized cleaning agents to remove dirt, cobwebs, bird/insect droppings, algae and mildew. Included is the cleaning of foundation, siding, and/or brick, shutters, window and door framing, and eaves. Cleaning will be performed with commercial grade, job-specific agents that will remove and slow future growth of mold and algae. All cleaning is done with low-pressure as not to damage the surfaces of the house. Unless otherwise stated, the customer shall be responsible for preparing the work site for services rendered. DFW Home Experts ISAOA, LLC will not be responsible for damage due to loose or faulty siding, stucco, wood trim, paint or any substandard maintenance condition. Any water leaking or drainage into, onto or around the structure like at doors and windows.
TERMINATION
This Agreement may be terminated by the Customer by providing at least 24 hours notice prior to the Service Time. DFW Home Experts ISAOA, LLC may terminate this Agreement by providing the Customer with at least 24 hours notice prior to the Service Time. DFW Home Experts ISAOA, LLC may terminate this Agreement with immediate effect if the Customer is in breach of this Agreement, and in the opinion of DFW Home Experts ISAOA, LLC , that breach is incapable of remedy.
PRIVACY POLICY
The Customer acknowledges that any information provided by the Customer may be used by DFW Home Experts ISAOA, LLC for the purpose of providing the Service. DFW Home Experts ISAOA, LLC agrees not to share any information provided by the Customer with any third party not directly involved in the provision of the Service (unless required to do so by law). The Customer agrees to DFW Home Experts ISAOA, LLC communicating with them electronically and/or via other means in order to provide the Service or for reasons related to the provision of the Service. DFW Home Experts ISAOA, LLC will take all reasonable precautions to protect personal information provided by the Customer from loss, misuse, unauthorized access or disclosure, alteration or destruction
